Wisconsin plans to purge 234,000 voters; Democratic governor won by 30,000

Democrats cried foul after a judge ordered a purge of nearly a quarter-million voters in response to a lawsuit filed by a right-wing group on Friday.

The Wisconsin Elections Commission sent a letter to nearly 234,000 voters in October warning that they needed to re-register in order to remain on the voter rolls because authorities believe they had relocated. “If you move, even to an apartment in the same building, you must update your voter record by reregistering,” the commission warned at the time.

The letter did not set a deadline for voters to re-register and the commission later said that voters would have until 2021 to do so. But the conservative Wisconsin Institute for Law and Liberty filed a lawsuit arguing that the commission is required to remove those voters within 30 days of sending the letter.

Ozaukee County Circuit Judge Paul Malloy, who was appointed by Republican Gov. Scott McCallum in 2002, agreed with the complaint on Friday, ruling that the commission must remove everyone on the list who does not re-register within 30 days, The Milwaukee Journal-Sentinel reports.

Democrats were hit hardest by the purge, the outlet noted. Milwaukee and Madison, which are the state’s biggest Democratic strongholds, received 23 percent of the letters despite making up just 14 percent of the state’s registered voters. Fifty-five percent of the letters were sent to districts that voted for Hillary Clinton over President Donald Trump.

Outrage as Georgia GOP Removes More Than 300,000 Voters From Rolls

A federal judge Monday night allowed Georgia to move ahead with a purge of over 300,000 voters deemed "inactive" by Republican Secretary of State Brad Raffensperger, sparking outrage from rights advocates who accused the GOP of an illegal voter suppression effort ahead of the 2020 elections.

"Georgians should not lose their right to vote simply because they have not expressed that right in recent elections, and Georgia's practice of removing voters who have declined to participate in recent elections violates the United States Constitution," said Lauren Groh-Wargo, CEO of Fair Fight Action, a voting rights group founded by former Georgia gubernatorial candidate Stacey Abrams.

Abrams lost to Republican Brian Kemp, the former Georgia Secretary of State who was widely accused of spearheading a mass voter suppression scheme before the 2018 election.

Fair Fight Action filed a lawsuit Monday calling on the court to "step in and stop this illegal purge," but U.S. District Judge Steve Jones allowed it to proceed while noting that he could still order the reinstatement of voters removed from the rolls. Another court hearing on the purge is scheduled for Thursday.

The Georgia voter rolls are expected to shrink from 7.4 million to 7.1 million by Tuesday morning. According to Fair Fight Action, 120,561 Georgia voters are being removed from the rolls solely because they have decided not to participate in recent elections.

Alex Kotch, investigative reporter with Sludge, warned Georgia could remain a red state in 2020 "due to the GOP purposefully denying people the right to vote."

The Georgia voter purge comes just days after a judge ordered Wisconsin to remove more than 200,000 voters from the rolls in response to a lawsuit brought by the right-wing group Wisconsin Institute for Law & Liberty.


In a statement late Monday, the advocacy group All Voting is Local raised alarm at the effort to "strip away the voting rights of 234,000 Wisconsinites."

"Voter purges pose a distinct threat to our democracy, causing disproportionate harm to the very voters who have long been disenfranchised: people of color, low-income voters, and those who move frequently," said Shauntay Nelson, Wisconsin state director of All Voting is Local. "This flawed ruling doesn't provide enough time or notice for voters to comply."

During a rally Monday night, Sen. Bernie Sanders (I-Vt.), a 2020 Democratic presidential candidate, condemned "Republican officials in Georgia and Wisconsin who are too cowardly to engage in free and fair elections."

"I say, get out of politics and get another job," Sanders said.


In a tweet earlier Monday, Sanders wrote that he has run for office many times but has "never said to [himself], 'How can I make sure those who might vote against me can't participate in democracy?'"

"That's what Republicans are doing today," said Sanders. "It's cowardice and they won't get away with it."

No, they want to game the system and disproportionately purge democrats. Over and over and over again. If they actually wanted to make official records more accurate there would be no serious objection from anyone, but over and over it is revealed that what they actually want to do is cheat.

It would seem to me that if you purge people who haven't moved for simply not voting or not returning a postcard, you're not keeping your registration as accurate as possible. You're actually making it more inaccurate.

If they moved and didn't update their address, how were they planning to vote? Voting in a precinct where you do not maintain residence (temporary or permanent) is voter fraud.

Wisconsin has same day voter registration in cases like this - not a major issue. All they have to do is update their address.

I've moved twice in the last 14 months and took the legal responsibility seriously that I was supposed to update my election board of my proper address.

Protesters at a polling site during early voting wave Confederate flags, shout slurs

A group of protesters waving Confederate flags and shouting "Trump 2020" gathered outside a polling site in Chatham County on Saturday morning.

Early voting had already begun at the polling site, while protesters shouted slurs and waved signs.

The group gathered to protest an event at the Chatham County Agriculture & Conference Center, where Chatham For All and Abundance NC invited the public to listen to four national scholars for a panel discussion called "The Civil War Today."

The event was an educational talk meant to offer historical perspectives on Confederate monuments

According to the Chatham For All event description, they hoped to have open public discussion about the ongoing controversy over the removal of Confederate monuments and symbols that they said were causing a stir by challenging family histories, estranging neighbors and distressing businesses and communities.

Four national scholars from UNC and Duke were there to "discuss the truths and fallacies of the Civil War and confederate symbolism today."

Twitter videos from one attendee showed protesters angrily shouting slurs at the crowd who gathered for the educational panel.



The event began Saturday at 10:30 a.m., according to their event page.

The attendance of protesters seemed to indicate just how controversial the removal of the monuments is, and to what extent disagreements about the monuments is impacting, and dividing, the community.

The protesting raised concerns about whether or not protesters should be allowed to gather near a polling site, particularly during early voting. However, an official explained, "The temporary polling center utilized a separate entrance and parking lot than attendees of the Civil War event."

According to officials, signage and other markers were in place to direct voters to the appropriate entrance.

Republican Party sends fundraising mail disguised as census as real count is about to start

If it looks like a census form, feels like a census form and even blares the word census all over it — it’s not necessarily a census form.

The Republican National Committee is mailing fundraising letters that closely resemble census forms from coast to coast.

“Enclosed is your official 2020 CONGRESSIONAL DISTRICT CENSUS … in your name as a representative of Yorktown Heights,” reads a letter sent to a registered Republican in Westchester County that was obtained by the Daily News. The missive even assigned the recipient a seven-digit “registered code” similar to codes used to access online forms for the real census.

“This is the largest Congressional District Census our Party has ever taken for a Presidential election,” the letter continues in two front-and-back pages of text.

“This is a perversion of the normal functioning of government,” said Susan Lerner, executive director of the good-government group Common Cause New York. “It’s timing is particularly objectionable because it will confuse people and discourage them from actually participating in the official census.”


The mailing also includes a large form with 41 multiple-choice questions that mimic the real 2020 census that will be distributed starting next month. At the bottom, there’s a large box to “certify” the survey and provide credit card details to make a contribution to the RNC.

While the questions are about political views — a no-no on the real thing, which collects a range of demographic info — critics say the RNC mailings could trick people into thinking they’ve completed a census and wreak havoc on the process of counting Americans.

Similar RNC mailings have been spotted in Ohio, Montana, Washington, and California, Lerner said.


Rep. Katie Porter (D-Calif.) grilled the Census Bureau’s director at a congressional hearing on Thursday.

“This is not the first time that we have seen the RNC … try to confuse voters by sending them a mailer that imitates the census,” the congresswoman said. “This mailing has already gone out, so the time to stop it has already happened.”

Census Bureau Director Steven Dillingham said he hadn’t seen the RNC’s mailings but promised to look into the issue.

“I’ve heard generally about the problem,” he said. “We will study this problem.”

Similar tactics from the RNC in 2010 prompted Rep. Carolyn Maloney (D-N.Y.) to write the Prevent Deceptive Census Look Alike Mailings Act. The law bars non-government groups from sending solicitations with the word “census” on the envelope, outside cover or wrapper through U.S. mail.


Maloney fumed at the emergence of a phony census from the RNC just outside the city.


“Clearly, the RNC has found a way to skirt the law deliberately, making their actions even more reprehensible,” she said in a statement. “These mailings sow confusion at a time when the public needs clarity about the census – putting an accurate count in danger.

“I am now working to strengthen the language of the Prevent Deceptive Census Look Alike Mailings Act so that these dirty political tricks can’t be used in the future.”

The RNC declined to disclose how many fake census letters it has sent in New York and nationwide.


“This ‘story’ is nothing new and has already been covered several times,” an RNC official said.

The Democratic National Committee has never sent fundraising mail disguised as the census, a spokesman said.

The mailings come as many states are spending millions of dollars to educate residents about the census, results of which determine political maps, federal spending and a host of vital civic functions. Gov. Cuomo allocated $60 million to census outreach, while the city is spending $40 million on the effort. The Trump administration dropped plans to ask people about their citizenship status, but the furor sparked fears that non-citizens and members of minority groups will refuse to complete census forms.


“Republicans seem to have a ceaseless imagination when it comes to both fundraising and undermining the accuracy of the census,” said Lowey, a Democrat who’s retiring at the end of this term. "Soliciting campaign donations under the guise of a census document is fraudulent, predatory and the latest way Republicans have threatened an accurate census count.”

Josh Eisen, a Republican running to succeed her, did not answer a request for comment.

The Department of Justice became aware of the Election Day incident and started an inquiry. In January 2009, less than two weeks before the Bush Administration left office, the Civil Rights Division of the Department of Justice filed a civil suit under the Voting Rights Act against four defendants, including Shabazz.[12][failed verification]

In April 2009 Bartle Bull, a former civil rights lawyer who was serving as a poll watcher at the polling station where the incident occurred, submitted an affidavit at the Department of Justice's request supporting the lawsuit, stating that he considered it to have been the most severe instance of voter intimidation he had ever encountered.[7]

When none of the defendants who were charged appeared in court to answer the charges, the career attorneys pursuing the lawsuit assumed that they would win it by default. However the move to pursue a default judgment was overruled by two of their line superiors, Loretta King, who was acting Assistant Attorney General, and Steve Rosenbaum, Acting Deputy Assistant Attorney General.[5] The federal government dropped charges against all defendants except Shabazz in May 2009.[13] A spokesperson for the Department of Justice stated that the claims were "dismissed against the other defendants based on a careful assessment of the facts and the law."[14] Questions about the validity of this explanation served as the basis for subsequent controversy over the case, which was investigated by the United States Commission on Civil Rights,[5] Republican members of Congress,[4] and the DOJ.[10] The federal government eventually obtained an injunction forbidding Shabazz from displaying a weapon within 100 feet of a Philadelphia polling location.

Wisconsin court overturns ruling that ordered removal of up to 209,000 people from voter rolls

A Wisconsin appeals court on Friday overturned a ruling that ordered the removal of up to 209,000 people from the state's voter rolls, handing Democrats a victory in a case they said was intended to make it more difficult for their voters to cast ballots in November.

The court last month put the ruling, and the purge, on hold while it considered the case. The 4th District Court of Appeals ruling overturned the decision of an Ozaukee County judge who had initially ruled in favor of a conservative law firm that was seeking the purge.

The appeals court also vacated an order from that same judge that found the state Elections Commission in contempt for not moving forward with the purge.

The appeals court sent the case back to the lower court and ordered that it be dismissed.

The case has received a lot of attention because Wisconsin is among a group of swing states being targeted by Democrats and President Donald Trump this year. Trump won Wisconsin in 2016 by fewer than 23,000 votes, putting even more of a focus on every voter in the state.

The voter purge lawsuit argued that the state elections commission broke the law when it did not remove voters from the rolls who did not respond within 30 days to a mailing in October indicating they may have moved. The commission wanted to wait until after the November 2020 presidential election before removing anyone because of inaccuracies found while previously attempting to identify voters who may have moved.

The appeals court said in its unanimous decision that the law in question does not refer to the Elections Commission or give any duties to it related to deactivating voters. The commission had argued that the power to do that rests with local election clerks and the appeals court agreed.

“In interpreting the Wisconsin Statutes, courts may not rewrite the plain language of the statutes the legislature has enacted,” the appeals court said. “Acceptance of the arguments of Plaintiffs would cause us to rewrite statutes enacted by the legislature, and that we cannot do.”

A spokesman for the Wisconsin Institute for Law and Liberty, which brought the case on behalf of three voters, had no immediate comment. The Elections Commission and state Department of Justice, which represented it, also had no immediate comment.

The ruling can be appealed to the Wisconsin Supreme Court, which previously declined to take the case before it was heard by the appeals court.

The League of Women Voters of Wisconsin also filed a federal lawsuit to stop deactivation of the targeted voters. The league describes itself as non-partisan, but it has been on the same side as Democrats on voter access issues.

Because voters who moved were concentrated in more Democratic areas of the state, liberals argued that the lawsuit was meant to lower turnout on their side. Republicans countered that it was about reducing the likelihood of voter fraud and making sure that people who have moved are not able to vote from their previous addresses.

Even if a voter has their registration deactivated, they can register again later or on Election Day when they show up at the polls, assuming they have the required documentation.

A three-judge panel in the 4th District of the appeals court — Michael Fitzpatrick, JoAnne Kloppenburg and Jennifer Nashold — issued Friday’s ruling. Nashold was elected to the court last year after running unopposed. Fitzpatrick also ran unopposed and was first elected in 2017. Kloppenburg has been on the appeals court since 2012 and also ran unsuccessfully twice for the state Supreme Court with Democratic support.
