The DOJ has said they will appeal. The problem is not a lack of evidence, it's that the Statute of Limitations has now expired. So I'm sure there will have to be a court ruling on that as well as the technicality issue.

he's talking about when Comey made the announcement in October 2016 (right before the election) that he was re-opening the investigation into Hillary's use of a private email server. And the timing of that announcement probably cost her the election and assured Trump of a win.
