Here in Florida, there's no loophole like that. If a cop finds you in the driver's seat with the car key in your hand, or worse with the car key in the starter, it's a presumed DUI if you're suspected of being drunk. The car doesn't even have to be turned on, and you don't even have to be awake. The cop can even assume DUI if you're on private property, even your own, car off and/or you're asleep. Source: my wife's friend with two DUI's to her name.

The only real loophole is if a passenger takes away your car key before the cop sees it in your hand or in the starter. Even then, according to Florida law, the cop can request a DUI blow if you're in the driver's seat, and either you blow or you're going to jail.

There was a party store across the street from our shop and I thought Jim,the guy working there was about the coolest. At the time I was 16 or so he must have been 40 or something. I eventually learned he partied pretty hard.He drove a corvette that was pretty cool. This was around 1980. I went over one day and bought some porn magazines and he said "would you be interested in any of these" and he reached under the counter and he had 8 mm porno flicks. I said "I don't have a movie projector" so he reached down and set a projector on the counter "Well,I can fix you right up". So I went back to work and told the guys and old Pete said "don't bother buying that stuff,I'll bring in my projector and a couple movies tomorrow". So next day we set up the projector. I remember one of them had a guy named Gene Damage "the rectum wrecker".
Anyway . Jim was talking to a guy one day when I walked in and he said "So I woke up at a stoplight at about 6 this morning and a state cop was right beside me and the light turned green so I drove away.I have no idea how long I had been there". He partied pretty hard.
I just remembered ,right down the road from me a guy got arrested for drunk driving on his lawnmower. The lawnmower didn't have lights and it was dark out but he had a light taped to the hood of the tractor but no taillight. When a cop approached him from the rear he didn't see him until he got pretty close so he stopped to tell the guy that he needs to put a tail light on the tractor and realizes the guy is drunk.So he got arrested.
