Whitmer kidnap suspect wants out of jail. He's diabetic, and fears COVID-19
After three weeks in jail, one of the suspects charged with plotting to kidnap Gov. Gretchen Whitmer is asking the judge to reconsider her decision to keep him locked up: He's worried about getting the COVID-19 virus.
Kaleb Franks of Waterford, a recovering heroin addict who says he has turned his life around after doing time for cocaine and home invasion, has diabetes and high cholesterol, takes insulin daily and fears contracting COVID-19 in jail, his lawyer argued in court documents filed this week.
The filing shed more light on the life of the 26-year-old defendant known as 'Red Hot,' who maintains that he can be trusted not to flee and that he is not a threat to society, despite the judge concluding on Oct. 13 that "he remains a danger to the community."
According to testimony and court records, Franks was part of the surveillance operation outside Whitmer's cottage and was one of five suspects who drove to a meeting hoping to buy explosives and tactical gear, only to get arrested in what turned out to be a setup by the FBI.
But Scott Graham, a Portage attorney representing Franks, argues his client posed no real threat to anyone and deserves to be out on bond, maintaining that when Franks got arrested at the setup "he took $23, hardly a 'down payment' for anything."
Graham is hoping to change the judge's mind about bond, citing the following details about Frank's life that he believes weigh in favor of releasing him: He owns his own house in Waterford; had a good job at Meridian Health Systems helping drug and alcohol addicts before his arrest; lives with his fiancée and her mother, both with clean records, and has the support of his family.

Whitmer kidnapping case defendant alleges informants 'repeatedly' pressured him to participate
Informants saw Fox's "chronic marijuana use" over the course of four months, and the agents would still pressure him.
The lead defendant in the alleged plot to kidnap Michigan Gov. Gretchen Whitmer "repeatedly" expressed that he did not want to participate in the conspiracy despite "persistent" pressure and "manipulation" by FBI informants, according to a court filing.
Adam Fox faces charges in relation to the kidnapping conspiracy and attempting to obtain a weapon of mass destruction. His attorneys wrote in a filing last week that he plans on using the defense of entrapment in court and pointed to Fox's drug use and statements against extremism in addition to the influence of government agents.
Fox and three other men, Barry Croft, Daniel Harris and Brandon Caserta, face charges in the Western District of Michigan Southern Division Court of conspiring to kidnap Whitmer. Fox, Croft and Harris face additional charges of conspiring to use an explosive device in the kidnapping plot.
Fox's defense argued in the latest filing that he "lacked the predisposition to commit a kidnapping or use a weapon of mass destruction and his participation was induced by persistent and repeated pressure and manipulation by government informants."
His attorneys admitted that Fox identified with the "Boogaloo" movement, but said the pro-gun movement "is more of a collection of economic and social ideas than it is an actual organized group."
In an undercover FBI recording of a meeting, Fox urged attendees to take steps to "address the negative perception that they are violent, destructive, 'domestic terrorists,'" defense attorneys wrote.

But his lawyer's arguments for his release are stupid. If I was the prosecutor, I'd say "No, he had a good job at Meridian Health Systems. He lived with his fiancee and her mother. He had the support of his family. All that shit is past tense now, because he's in jail."

There's a former mafia captain's youtube channel that I follow and he talks now and then about setup jobs by the FBI. He left the life and has no reason to lie about it. He had no problem with the FBI doing their job and using all their resources to prosecute gangsters, but he mentioned that in several cases, they made things up. Ironically, Comey's name came up as an agent who did it quite often and made his name doing that.
